filing them under a civilian case under those chargeless. federal charge of at the same time state murder charges and that's what sources are telling fox newings, the reason he was not given the miranda rights is that under the law, under a approximate exemption that has to do with immediate threats to the police or public. there is a part of the law that said you don't have to give miranda rights to a suspect to immediately protect the police in a life or death situation. the idea is that when they got him in the boat, they don't know if there are other plots or bombs or devices that the brothers had allege wouldly planted. that was a way to get immediate information about the type of threat they may have posed. dzhokhar remains here in the hospital in serious condition. he lost a lot of blood and

suffered two gunshot wounds one in the neck and head one from the car jacking case on thursday night with his brother . the homeowner saw a lot of blood and ironically had authorities had not lifted the shelter in place, he may not be alive today. more on that today. security here is very tight and police are going through bags çfor id's. there is a high level of security in the hospital. he is expected to be questioned by a federal special team that deals with high-value detainees and try to question him about his background and did he or his brother have contact terrorist groups and what did his brother do when he went to russia and came back october 17th . did he attend training camps and were they radicalized and that sort of thing. back how it went down it is

ironic he may not be alich. they lifted the ban at 6:00 and within an hour that's when the man who owns the house and boat was able to get out and find him f. that ban would have been in place, he might have died in the boat and now dzhokhar is alive and potentially facing charges and potentially could give authorities a lot of information, back to you. >> just to update you and i have e-mail and would communicated with friends that are lawyers . they tell me just balse the justice've because the justice department is hoping to file charges does not mean they will not treat him as an enemy combatant. i don't know if they are great lawyers and graduated in the top of their class. but nevertheless you can still file charges and still be treating a suspect as an enemy combatant. we'll know soon when the

help us off of the ledge here? >> what you are talking about is real. the scary thing here, you and i both know in what is happening in the weekings and weeks and days that bad things can happen. it is scary. we have increased anxiety and fear. one hand it is realistic . we have an element of not having control over bad things can happen. but statistically happening, the possibility of you and i being a victim is small but it is scary and it is something we need to talk about as individuals in the country. >> what if it is it proven that this goes beyond the two brothers where they are part of the a cell and series of super cells. that changes this fear factor a lot, doesn't it?

it is hard to believe it hasn't been a week, but what a week. just last saturday, boston was a city merrily preparing for a marathon and now resident now peeking their head out from a lock down. one moment an eight year old little boy waiting in the finish line for dad to finish the race and the next dead in total mayhem. i see pictures like this complete with the white capped killer leaving the scene and makes me want to stop and reverse and change the seen. i feel like screaming get out

the mad days later added to the victims of the madness. alive and well just days ago just like all of the good folks in texas who would be obliterated in a plant explosion who didn't know they had just day to go. a week ago they were all here. they were with us, among us . breathing the same air and walking the same planet and then gone. leaving us wondering, leaving me wondering not so much why it all happened but how fast it all happened. we cling to the images when they were okay and unable to fathom how truly brief everything is okay . i guess that is why we cling to photoalbums of loved ones long gone. it makes us curse the moments we lost them and treasure the brief moment we had them when
